Business Law: An Introduction

This Unit is designed to introduce you to the framework of law as it applies within the business environment. It will cover -

  • The main sources of Scots Law
  • The Law of Contract
  • The formation, management and dissolution of business enterprises

Assessments will take the form of answers, which you will provide in response to a specific question or questions. In these answers, you will need to provide evidence to show that you can give an accurate and clear explanation of a legal aspect of the law, as it relates to a given case study or case studies. Although you will be required to study the full range of topics in the bulleted list above, you will only be assessed on part of each of these topics. You will not know beforehand which parts of these topics will appear in the assessments. You will need to show that you fully understand the following:

Outcome 1: Common Law, Statute Law, European Legislation, Civil and criminal law.

Outcome 2: The differences between an agreement and a contract, Illegality and Errors as they relate to a contract, The causes/reasons for termination of a contract, Breach of Contract, Remedies for breach of contract.

Outcome 3: Sole traders, partnerships and incorporated bodies, Legal requirements of running an incorporated body including the ability to enter into contracts, Legislation affecting the formation, running and dissolution of an incorporated body, Business Contractual Relationships.
